CBD was legalized in the United States back in 2018. This has since given rise to companies producing CBD-infused food and drinks. 

Cannabidiol is infused in gummies, carbonated drinks, jelly beans, baked goods, and more. 

Without specific demarcation of the use of CBD, most consumers are left confused and misinformed whether it’s safe and legal in edible forms. The answer isn’t as simple as you might expect.

The 2018 Farm Bill passed in the United States of America made the cultivation of hemp legal and removed CBD from the Schedule I restricted drug status.

Despite this legal hurdle, you can find CBD food products almost everywhere. Many of these companies risk fines or shut-downs for selling these products, but the FDA has yet to take any physical action against these products. 

As the use of CBD is not fully regulated, some food and beverage products that come with this ingredient might make false claims as to its health benefits — which is illegal.

Despite not being approved for sale, CBD is sold in food all over the United States. 

Until the Food and Drug Administration includes CBD in the safe-to-use list of food additives, it will be illegal to infuse it in food products.
